Mining Lease <br />Sand-Rock-Gravel <br />This Lease, Made This ~ 5 day of ~iv~. <br />2002, Between Ronnie <br />Davis whose address is 33590 County Road 19,Holly, Colorado 81047, hereinafter referred to as <br />Lessor, and PROWERS COUNTY, COLORADO, whose address is 301 S. Main Street, Suite <br />205, Lamar, Colorado 81052, hereinafter referred to as Lessee. <br />Witnessed: <br />In consideration of the sum of One Dollaz ($1.00) and other valuable consideration, <br />receipt of which is hereby acknowledged, Lessor herby leases to Lessee the tract of land shown <br />below from the date of the Lease until the '~ 9 rlL Day of ~,' , 20 O ~ for the <br />purpose of quarrying, mining, removing and marketing there from all sand, gravel, rock and <br />other construction materials. Said land is situated in the County of Prowers, in the State of <br />Colorado, and is described as follows: <br />Section, 19 Township 22 South, Range 44., Prowers County, Colorado, Lot 3, North of <br />the Railroad Right ojway, NE '/. SW '/ North of the Railroad Right of way, All of Lot I And 2, E <br />%NW`/.. <br />1. Price: Lessee shall pay Lessor Quarterly on or before the 10'" day of the following <br />month for gravel and overburden hauled from the premises at the minimum sum of per ton <br />and or at a rate equal to countywide rate for rock products, said sum to be determuied on a <br />quarterly basis. Lessee shall maintain records of truckloads hauled from the premises, which <br />shall be furnished to Lessor, and each truck hauling material will be designated on Lessee's <br />records. Lessee will cause test loads for each truck to be weighed at Lessor's request. However, <br />it is not the intention of the parties that each truckload be weighed. <br />2. ACCeSS: Lessee shall have the right of ingress and egress to and from the premises <br />on roads presently located on said tract or upon roads constructed by Lessee together with the <br />right to erect temporary structures such as screening and crushing plants, asphalt plants and other <br />structures necessary to remove and process gravel. <br />3. Option To Renew: Lessee shall have the right and option to renew this Lease for <br />successive periods of Five (5) yeazs each upon the same terms and conditions set forth herein. <br />4. Stockpiles: Lessee shall retain title to all sand and gravel mined and stock piled on <br />the premises, and Lessee shall have the privilege of stockpiling sand and gravel during the term <br />of this lease, until all pit reclamation has been completed to the satisfaction of the Division of <br />Minerals and Geology. Lessee shall pay at the rate above set forth for stockpiled rock, crusher <br />fines and sand as the same is removed. Stockpiles must be moved within one (1) year after said <br />Lease is terminated, or paid for in advance with the Lessor's approval. <br />
