Amount of Mitigation Payment for Sand and Gravel Operations Amount of mitigation of road impacts due to hauling of sand and gravel for construction of subdivision roads shall be determined pursuant to Section 5-1602 A. and paid by the developer as part of the Subdivision Improvements Agreement required by Section 3-1204. The amount of mitigation of road impacts due to hauling of sand and gravel for individual home construction shall be determined through building permit fees established by resolution of the Board of County Commissioners. 5-1602 C. Alternative to Direct Payment The Board of Commissioners may approve a contract submitted by the applicant adequately addressing mitigation of anticipated road damage. The contract shall provide for reimbursal to the County for actual damage to County roads, based on the road improvements and conditions of said road(s) in place at the time of the issuance of the special use permit, and may be reduced for a particular mining operation based on consideration of the following factors: Overall economic effect upon the County Budget (e.g., employment, production taxes, property taxes, etc.); II. Commitment by the applicant to repair directly damage caused to County roads; III. Commitment by the applicant to provide materials for repair of damage caused to County roads; and IV. Whether or not the County road(s) to be used were previously improved at the mining industry's expense. 5-1602 D. Additional Payment for Unanticipated Damage The applicant shall also be required to reimburse the County after repairs are made for any damage that could not reasonably be anticipated at the time of permit approval, the amount of which shall be calculated by the Road Superintendent.
