Amount of Mitigation Payment for Sand and Gravel <br />Operations <br />Amount of mitigation of road impacts due to hauling of <br />sand and gravel for construction of subdivision roads <br />shall be determined pursuant to Section 5-1602 A. and <br />paid by the developer as part of the Subdivision <br />Improvements Agreement required by Section 3-1204. The <br />amount of mitigation of road impacts due to hauling of <br />sand and gravel for individual home construction shall <br />be determined through building permit fees established <br />by resolution of the Board of County Commissioners. <br />5-1602 C. Alternative to Direct Payment <br />The Board of Commissioners may approve a contract <br />submitted by the applicant adequately addressing <br />mitigation of anticipated road damage. The contract <br />shall provide for reimbursal to the County for actual <br />damage to County roads, based on the road improvements <br />and conditions of said road(s) in place at the time of <br />the issuance of the special use permit, and may be <br />reduced for a particular mining operation based on <br />consideration of the following factors: <br />Overall economic effect upon the County <br />Budget (e.g., employment, production taxes, <br />property taxes, etc.); <br />II. Commitment by the applicant to repair <br />directly damage caused to County roads; <br />III. Commitment by the applicant to provide <br />materials for repair of damage caused to <br />County roads; and <br />IV. Whether or not the County road(s) to be used <br />were previously improved at the mining <br />industry's expense. <br />5-1602 D. Additional Payment for Unanticipated Damage <br />The applicant shall also be required to reimburse the <br />County after repairs are made for any damage that could <br />not reasonably be anticipated at the time of permit <br />approval, the amount of which shall be calculated by <br />the Road Superintendent. <br />
