<br />Farmer/Special Use Permit/May 10, 1995/Page.4 <br />medical, hospital and medical, drainage system and <br />schools. <br />Review Standards for Mining Operations <br />Land Use Code Section 5-16 establishes the standards for 'the <br />Planning Commission to use in reviewing all mining operation <br />applications, which the applicant must address in the Standards <br />Report required by Section 4-206: <br />5-1601 Applicability <br />The hauling threshold above which mines, quarries and sand and <br />gravel operations are allowed through One-step-Planning <br />Commission Review per Section 5-307 D.IV. (one million pounds of <br />mined material) shall apply to the total amount of mined material <br />proposed for hauling from a mine or mine complex owned or leased <br />by a single operator within a twelve-month period. <br />5-1602 Mitigation of Hauling Zmpact on County Roads <br />Each applicant for a One-step Planning Commission Special Use <br />Permit f'or mining (pursuant to Section 5-307 D.IV.) shall as a <br />condition of any permit approval pay the County in advance on a <br />monthly or annual basis to cover the estimated damage such <br />operation may cause to County roads. <br />5-1602 P.. Amount of Mitigation Payment <br />The amount of payment shall be determined using the <br />following formulas, with road types and distances to be <br />designated by the County Road Superintendent: <br />I. Paved Roads - Payment negotiations shall <br />commence using a baseline fee of $0.02/ton/ <br />mile. Fees will be established by a contract <br />with the Board of County Commissioners and <br />may be adjusted upward or downward with <br />adequate justification. The fees may be <br />adjusted downward by applying considerations <br />of 5-1602 C., and the contract shall provide <br />for underpayment and overpayment in <br />accordance with Sections 5-1602 D, and 5-1602 <br />E.; <br />II. Improved Gravel Roads $.03/ton/mile; and <br />III. Unimproved Roads - the Road Superintendent <br />will provide an amount based upon estimated <br />impact. <br />
