C & M Companies will maintain an annual monitoring program <br />to determine the success of the wetlands re-establishment <br />program. The monitoring program will Include compiling a <br />photographic record at the end of each years growing season <br />to determine the density and diversity of plant growth. <br />Corps of Engineers staff will inspect the site on an annual <br />basis to determine the progress of the mitigation. At the <br />end of five years a final determination will be made on the <br />success of the mitigation plan. If the proposed mitigation <br />is not successful, C & M Companies will revise the proposed <br />plan and present a new proposal to the Corps of Engineers <br />within two months. If the proposed mitigation is <br />successful, then all agencies involved will give their <br />written acceptance and no further monitoring of the <br />mitigation plan will be required. <br />It i:s my understanding C & •M Companies will be allowed to mine <br />the property in a dewatered condition and perform all reclamation <br />activities including backsloping and topsoiling of shorelines <br />without a 404 permit for this specific activity. It is also my <br />understanding the Corps of Engineers' jurisdiction will extend to <br />the :shorelines of the lake after the mining and reclamation is <br />completed and only after dewatering has halted and the normal <br />high water surface of the lake has established itself. <br />Terry, I believe this covers all concerns voiced by the reviewing <br />agen~:ies during our field trip. C & M Companies has shown good <br />faith in working with all concerns. The mitigation plan is <br />soun~9, simple and verifiable. I appreciate the help and input <br />you leave given on preparing this permit application.
