Please supply a copy of any documents that will ensure that the area of extraction will be reclaimed to <br />some beneficial land use once extraction activities have been completed. <br />13. Do you have permits for this activity from any other governmental agencies, and, if so, what are they? <br />14. Are there state/federal/local agencies participants in terms of funding (yes) (no), or design (yes) (no)? <br />What are the percentages? <br />We trust that the activities will or have been performed as represented. Dirt Merchant Construction should complete <br />the questionnaire as soon as possible but no later than March 24'", 2006. <br />If there is a hearing on this matter, we recommend that Dirt Merchant or its representative be present at the meeting <br />when the matter is considered. By Rule, the Division will notify Dirt Merchant 30 days prior to the date and place of <br />the hearing. Dirt Merchant will be encouraged to make its own presentation and answer questions by the Board. If <br />this matter is scheduled for a hearing, Dirt Merchant should prepare 10 copies ofthe material it wishes to present to the <br />Board. The Division needs to receive the material 10 days prior to the scheduled Board hearing date, so that staff has <br />time to distribute your copies to the Board for their use during the meeting. <br />The Division will present the facts of its inquiry as they pertain to the Construction Materials Rules and Regulations. <br />Staff may recommend to the Board that you need a permit. That recommendation will be based on the questionnaire <br />content, gathered facts and conversations with you in its regard. <br />The Division's recommendations, however, are not always followed. The Board will make the final decision on this <br />matter. If the Board finds that the referenced activities constitute an illegal mining operation, Dirt Merchants maybe <br />subjected to civil penalties of not less than one thousand dollars per day and no more than five thousand dollars per day <br />for each day the land has been affected, not to exceed three hundred and sixty-five days and required to obtain the <br />appropriate permit. <br />Sincere] <br />G.
