Re: Need For State Reclamation Permit Inquiry, No. M-2006-027, Dirt Merchants Construction.
Dear Mr. Wells:
The Division of Minerals and Geology has received a written inquiry concerning activities on your lands in the Delta,
Colorado Area. By law, the Division is required to investigate any activities that may require a reclamation permit
under the Colorado Construction Materials Rules and Regulations. In order for the Division to ascertain whether a
reclamation permit is required or the activities are exempt from such regulations Division staff request you fill out this
questionnaire.
The Board has directed the Division to make a preliminary determination, regarding the activity and to advise you of
that determination. If the Division makes an initial determination that Dirt Merohant Construction needs a reclamation
permit, the Division will schedule a hearing before the Board for a final determination.
Please answer the following questions in as much detail as possible, It is recommended that responses be made on
separate paper to allow for as much information as possible. The more information staff has the better the preliminary
determination can be made. These are some of the questions the Boazd typically asks during such determination
hearings and aides the Division in its preliminary determination as well.
1. Please give the legal location of the proposed project and submit an index map that clearly delineates
the location of the proposed extraction site and the location of the nearest city, town, and county
location name.
2. Is the site of material extraction public or privately owned property?
3. What types} of material is proposed or has been extracted?
4. Has the extracted material been hauled offsite or has it been used on the same parcel of property
where the material is extracted?
5. What on site use will be made of the extracted material?
6. If the material has been hauled offsite, where has it been hauled and what is the intended use?
7. What is the approximate area extent of the disturbance in acres?
