The following items need to be addressed before the Division can issue <br />a Reclamation permit. <br />1. Mining Plan. <br />a. Some of the language in the Mining Plan (Exhibit D) is not clear. Please <br />commit to no mining below an elevation that is eight (8) feet above the <br />mean high water mark. (I believe that this is what you intended to say.) <br />b. Please indicate the elevation of the Mean High Water line. <br />c. Because this is a Phased Operation, and because Phased Operations must <br />carry out reclamation concurrently with mining, the total amount of <br />disturbance is considered to be all of that land that is under <br />reclamation and all that is being mined. For purposes of these <br />considerations and in order to calculate the reclamation bond, the <br />Division will interpret the mining plan as follows. <br />No more than ten (10) acres will be disturbed at any one time. <br />Please commit to this interpretation or submit documentation in the form <br />of a more explicit mining plan that clearly indicates a different amount <br />of disturbance. <br />2. Wildlife Information <br />a. The wildlife section indicates that the only species which occupy the <br />mine site are mice and jackrabbits. This is not accurate. This area is <br />known to lie in the feeding lanes of elk, and is a part of several avian <br />flyways. <br />Please consult with persons at the Division of Wildlife or other regional <br />experts and list all species of wildlife that occupy this area, either <br />permanently or seasonally. <br />COLORADO <br />
