<br />1. Plaintiffs are residents and/or latrdowners n the Animas
<br />River Valley, County of I,a Flats, State of Colorado, adjacent to
<br />the land use project which Complaint i.s made and will suffer
<br />injury irr fact as a result of the approval of said pr ject.
<br />2. The County of La Plata, State of Colorado, is a leoliti-
<br />ca1 subdivision of the State exercising tare powers of a County
<br />under Coloradv law, includitrg but not limited to tlc Pxercise of
<br />certain planning functlons pursuant to Title JU, Art'cle 28, Part
<br />I, C.R.S. The Defendant Board of County Cormcissione s, County of
<br />La Plata, State of Colorado, is the named Defendant pursuant tv
<br />tire provisions of §30-11-105, C.F.,S.
<br />3. Joltn Dillvn, d/b/a Sarrdco of llurango was lie Applicant
<br />in Project 86-210, seeking approval of a sand e:~tract on operation
<br />located on the Animas River approximately two (2) m'les north of
<br />Durango and, as the Applicant for approval of such p oject, is ate
<br />indispensable party. herein.
<br />4. Tite Defendant Board of County Conunis:;io er ; approved
<br />said application by Resolution ]987-'.!3 on I4arcle 17, 1987, a copy
<br />of which is attached hereto as E:cleibit "A" and incvrp rated Irerein
