Martinek: <br />I.ANU <br />N Dlvlg[nN <br />Pursuant to our telephone conversation of May 7, 1987, please be advised as <br />follows: This firm represents several property owners adjacent t the proposed <br />Willow Bend Sand Pit, all of whom oppose the issuance of any perm t for same. <br />It is my understanding that the County has transmitted to Mined nd Reclama- <br />tion a form purporting to approve the Pit under all applicable Co my resula- <br />tions. Please be advised that my clients have attacked the vali ity of the <br />County's action in Court in District Court, County of La Plata, State of <br />Colorado, Case No. 87CV184 and are seeking an Injunction against he issuance <br />of any such permit by the County. <br />My clients would therefore request that the Hearing set for Y~ay 7, 1987, in <br />regard to this matter be continued, since the action by the County is not final <br />at this point in time pending review by the District Court. If ur District <br />Court action is successful, this would result in revocation of he County <br />permit, and a mined land permit could not be issued under the pr visions of <br />Section 34-32-115(4)(e), C.R.S. <br />Copies of all pleadings filed to date are enclosed for your conve~ence. Also, <br />please consider this letter and document enclosed herewith as publ c comment on <br />the merits of the application.
