[phone] will respond to any requests relative to well malfunction. He will
respond and repair the systems as needed.
On October 1, 2003, if the wells in question have been repaired Kirk Kirby will
certify that the wells are functioning and the balance of the escrow funds will be released
to the 124a' Estates Partners. Attachment A

Escrow Agency's fee will be X250.00 payable at the execution of this agreement by the
Escrow Agent. Any additional time involved by Escrow Agent for such things as
disputes or continuing the escrow beyond October 1, 2003 will be charged at it's then
current hourly rate and deducted from the escrowed funds.
