The Boazd, having considered the evidence concerning potential impacts caused by <br />blasting activities at the quarry site, and at the recommendation of the >)ivision and with <br />the concurrence of the Applicant, has determined to add a condition contained in the <br />Division's Rationale that requites installation of seismographs at locations to be approved <br />by the Central CityBlack Hawk Sanitation District. The condition ("Condition #3"} is <br />set forth in the Order below. The seismographs are to monitor each gttatry development <br />and production blast. Seismograph records ate to be kept for a miwimum of three years. <br />If the Central City/Black Hawk Sanitation District refuses to allow access for <br />seismographic monitoring, the Division will reevaluate the blasting condition and will <br />require submission of a technical revision by the Applicant. <br />14. The weight of the evidence demonstrates that with Condition #3, the Applicant has met <br />the m;n;,r,~ requirements of Rules 6.4.4(1) and 6.5{4). <br />15. Issue 7(C), Identification of Structures within 200 Feet of Affected Land (Rule <br />6.4.19-Exhibit S)_ Rule 6.4.14(b) sets forth a compliance option allowing the Applicant <br />to submit an appropriate engineering evaluation demonstrating that suuctures within 200 <br />feet of the affected land shall not be damaged by activities occurring at the mining <br />operations. As set forth in the Division's Rationale, the Applicaot complied with this <br />requirement by submitting a geotechnical analysis prepared by Lyman Henn, Inc. <br />demonstrating that such structures will not be damaged by Honing activities. The <br />Applicant provided revised maps C-1, C-2A, C-2B and C-2C, which accurately show the <br />MMRR Board Order, M-2004-0G7 <br />
