- .. <br /> <br />Mr. Joe Kurys - 4 - September 11, 1992 <br />Exhibit G <br />This concern has not been resolved. Evidence of ownership has been provided <br />for the tract adjoining the nursing home in NE SW Section 32 and the tract <br />northwest of Pond 1, but not for the tract immediately north of Pond 1 where <br />the mining is actually to occur. <br />the applicant must provide evidence of ownership or right of entry to the tract <br />of land intended for mining and, presumably, to comprise the permit area. <br />Exhibit I <br />the receipt of information by the Rio Grande County Clerk and Recorder is <br />indicated to be May 14, 1998 which is before the Division accepted the <br />application as complete. There is no evidence provided that a complete or <br />amended copy of the application was ever filed with the Rio Grande County Clerk <br />and Recorder. <br />The applicant must provide evidence of filing a complete as well as an amended <br />application with the Rio Grande County Clerk's office as required by Rule <br />3.2(3)(b>(ii) and Rule 1.5.1. <br />General <br />There remain too many unresolved problems with this application to approve it <br />by the August 14, 1992 decision date. If the Division's review is to continue <br />and denial of the application avoided, the City of Monte Vista's right to a <br />decision on that date must be waived. <br />~ihe permit application file is now disorganized and confusing. It consists of <br />pieces of several attempts by the City to address completeness and adequacy <br />issues without the information provided being clearly identified as to exhibit <br />number. There also appears to be information included in the file that may not <br />now be intended by the applicant to be part of the application and which <br />prevents a clear understanding of what the application contains, eg. land <br />descriptions, evidence of ownership, land maps. The application requires <br />careful reorganization, the drawing together under the correct exhibit headings <br />all information intended to be included in that exhibit, as well as inclusion <br />of all remaining necessary information.
