.: <br /> <br />Mr. Joe Kurys - 3 - September 11, 1992 <br />Exhit~it C (cont'd) <br />1'he Division understands that nos. 8-13 under this exhibit are not believed by <br />t:he applicant to apply to the proposed operation. <br />Exhibit fl <br />i~he Division understands that only adobe from the city streets will be placed <br />in the areas of excavated gravel. <br />Exhibit D (cont'd) <br />The Division understands from the Exhibit E maps that the affected land in the <br />tract north of Pond 1 will be graded level. <br />Exhibit D (cont'd) <br />The Division believes that by committing to replace 6" (or 12") of topsoil and <br />by indicating on Exhibit E maps the location of topsoil stockpiles that the <br />City intends to salvage some thickness of topsoil to be used in reclamation. <br />There is no statement that the stockpiled material will be stabilized by <br />vegetation if it is not used within one growing season. <br />The applicant should specify, as also requested under Exhibit C, what thickness <br />cf topsoil is to be salvaged and employed in the reclamation and how the <br />stockpiles will be stabilized if the material is not used within one growing <br />season. <br />Exhibit D (cont'd> <br />There is not an acceptable revegetation plan provided with the adequacy <br />response. The statement that trees m~ be planted is not acceptable since this <br />is not a commitment to do so and no details are provided as to what will be <br />planted and in what density. <br />The applicant must provide an acceptable revegetation plan in order for the <br />Division to approve the application. <br />Exhibit F <br />These maps may generally be acceptable if the permit area is only to include <br />the 4 acre (or larger) tract immediately north of Pond 1. While outlines of <br />the "area actually involved", presumably the area to be mined, and the <br />stockpile areas can be accepted as identifying the affected areas, the permit <br />boundary is not clearly labeled. The note on the map that says the area <br />outlined is as described in the legal is incorrect. The area described in the <br />legal is the tract northwest of Pond 1. <br />The permit area outline should be labeled, the legal description under Exhibit <br />A should correspond with the tract indicated on the Exhibit E map, and a right <br />or entry to this area should be provided. <br />
