Long, <br />Division Director <br />I have reviewed the above referenced response and continue to have the <br />following adequacy concerns. <br />Application Form <br />The Division's concern about the amount of affected area is addressed; the <br />City does not intend to affect more than 10 acres which qualifies it for a <br />110(2) permit. The size of the permit area, however, still remains a concern <br />since what is outlined on the Exhibit E maps as the permit area does not total <br />the 17 acres indicated on page 1 of the application form as the amount of <br />permitted acreage. <br />The applicant must resolve the differences in the acreage values given for the <br />permit area which appear on page 1 of the application form and the acreage <br />value apparent for the tract outlined on the Exhibit E maps. A revised page 1 <br />should be provided if the tract indicated on Exhibit E maps is all that is to <br />be included in the permit area. <br />Notices <br />Your response included evidence of the publication in the Monte Vista Journal <br />of the notice of filing of the permit application on May 13, 1992. Apparently <br />a copy of the application was also received May 14, 1992 by the Rio Grande <br />County Clerk's office. The application first received by the Division on <br />June 3, 1992, however, consisted of only the first page of the application form <br />and was indicated to be incomplete by the Division in its letter to you dated <br />June 16, 1992. In that letter, you were advised that a complete application <br />was necessary and that if you had already initiated publication, you.would need <br />to republish in conjunction with the submittal of a complete application as <br />specified in Rule 3.2(3)(b>(iii>. The Division did not receive what it <br />considered to be a complete application until August 14, 1992. <br />Evidence of publication of the notice or" filing on or after the receipt of the <br />c~cmp12t9 application by the Division should be supplied and a 10 day period for <br />comment following that publication date should be specified in that notice. <br />Evidence of filing a complete application with the Ric Grande County Clerk's <br />office on or after the August 14, 1992 date should also be supplied. <br />STATEOF COLORADO <br />
