Everist's 112 Permit Application for Maryland Creek Ranch, <br />Permit No. M-96-049 <br />Dear Ms. Kamnikar: <br />The Summit County Department of Community Development, Lower Blue Platming Commission and Board of <br />County Commissioners have reviewed L.G. Everist's application for a Regular Operation (112) reclamation permit <br />for the proposed Maryland Creek Ranch gravel and sand mining operation and have the following comments: <br />Post Minine Land Use: The application indicates that "rangeland" will be the post mining land use. The application <br />also states that within the 216 acre permit boundary approximately 106 acres are intended to become water surface, <br />5 acres will be roads and 8 acres will be devoted to ranch headquarters and associated buildings, leaving only 97 <br />acres as rangeland. These figures however, do not reFlect the fact that there are currently 23.4 acres of existing <br />jurisdictional wetlands within the pertrtit boundary. Additionally, the applicant is proposing to create 4.8 acres of <br />wetlands, including fencing and buffering to keep cattle out of these areas, as mitigation for their proposed fill of <br />approximately 3.3. acres of wetlands in the processing area. I[ would appear that the amount of land within the <br />permit boundary which could possibly be used as rangeland is only about one third the total land area. <br />The Colorado Division of Wildlife has reviewed this application and indicated that as many as 4t animal species <br />(some of which are identified in Exhibit H of the application) have been found to use the habitat type found within <br />the proposed Maryland Creek Ranch permit boundary. Of the 41 species identified 14 are considered to be special <br />status species, including Federal migratory, candidate and endangered species, State threatened species and U.S. <br />Forest Service sensitive and management indicator species. <br />It would seem that rangeland is neither the most appropriate nor the predominant post mining land ttse within the <br />permit boundary. The County believes that it would be more appropriate for the Division of Minerals and Geology <br />to review this application with consideration of the post mining land use being "wildlife habitat". <br />Section 306 of the Clean Water Act: Section 306 requires source performance standards and monitoring <br />requirements. The proposed Maryland Creek mining plan states that the proposed mining operation will comply <br />with all applicable federal and state water quality laws and regulations.
