Prior to sending the draft permit to public notice, we are requiring <br />the submittal of certain documents by you. <br />The discharges from outfalls 11005 and /1007 are new source discharges as <br />defined in 40 CFR 122.2. As a new source, schedules of compliance and interim <br />limitations are not permitted, reference 40 CFR 122.47(a)(2). Further, 40 CFR <br />122.29(d)(4) states in pertinent part that a new source "shall install and <br />have in operating condition, and shall "start up" all pollution control <br />equipment required to meet the conditions of its permit before beginning to <br />discharge." <br />On this basis, we are requesting that you submit to this office by September <br />30, 1985, plans and specifications plus any bench test data for the wastewater <br />treatment system(s) to be installed at the facilities; such system(s) shall be <br />capable of meeting the limitations contained in Table 1 attached to this <br />letter. Limitations are those proposed to be included in the renewal permit. <br />The limitations are based upon a Q7-10 of zero for the receiving water. <br />Based on a review of historical data from these discharge points, several of <br />the limitations cannot be met with the existing systems. <br />if, upon review of the plans and specifications and data, we find such <br />system(s) to be adequate, the permit will be conditioned to allow discYiarge <br />from these outfalls once such treatment system(s) is (are) installed and in <br />operation. Please note that 40 CFR 129(d)(4) further states, "within the <br />shortest feasible time (not to exceed 90 days) the owner or operator must meet <br />all permit conditions." The division interprets Chis to mean "within 90 days <br />after permit issuance." Noncompliance following the 90 day period will result <br />in discontinuance of the authorization to discharge, i.e., the discharge shall <br />cease. <br />
