Colorado Mined Land Reclamation Board <br /> November 9, 1978 <br /> page 2 <br /> of zoning were proper. It is my clients ' intentions to follow <br /> this matter through the courts to the fullest limit of the law. <br /> My clients feel that any issuance of a permit at this time by <br /> the Board would be premature, in that there is no determination <br /> as to whether the proposed use by the applicant is proper. <br /> My clients further feel that since the Division of water <br /> Resources in a letter to the Mined Land Reclamation Board, <br /> dated August 14 , 1978, specifically set forth that it could <br /> not recommend approval of Best-Way Paving Company' s permit <br /> until the Water Court in Weld County had issued a decree for <br /> its augmentation plan, that the Petitioners have not complied <br /> with the requirements of the Board. Subsequent to the Division <br /> of Water Resources ' letter to the Board, a letter was submitted <br /> by Robert F. Matthias, representing Best-Way Paving Co. , on <br /> August 25, 1978, stating to the Board that Best-Way Paving Co. ' s <br /> augmentation plan was merely "days away from final approval <br /> in the Water Court" . As of November 13, 1978 , Best-Way Paving <br /> Co. ' s augmentation plan had not even been set for hearing before <br /> the Water Court in Weld County. By checking with the Water <br /> Court it can been seen that their docket is quite crowded and <br /> it will be sometime before this matter can be heard before the <br /> Court. <br /> My clients further feel that the proposed mining operations <br /> and reclamations cannot be carried out in conformance with the <br /> requirements of 1973 C.R.S. 34-32-116 and C.M.L.R.B. Rule 6 . <br /> The legislative intent of the Colorado Mined Land Reclamation <br /> Act is set forth in 1973 C.R.S . 34-32-102 , as allowing for <br /> the continued development of mining industry in the State, <br /> "while requiring those persons involved in mining operations <br /> to reclaim land affected by such operations so that the affected <br /> land may be put to a use beneficial to the people of this State. " <br /> The term "reclamation" is perhaps the most important guideline, <br /> as the purpose of the Act is to provide standards for a meaning- <br /> ful reclamation of mined lands; " 'reclamation ' means the employ- <br /> ment during and after mining operation of procedures reasonably <br /> designed to minimize as much as practicable the disruption from <br /> the mining operations and to provide for the rehabilitation of <br /> the affected land to the rehabilitation of plant cover, soil <br /> stability, water resources, or other measures appropriate to the <br /> subsequent benefit of such mined and reclaimed land. " 1978 C.R. S. <br /> 34-32-103 (13) . It is the position of H.O.P.E. , that the applica- <br /> tion submitted by Best-Way Paving Co. is not reasonably designed <br /> to minimize disruption from the mining operation or reasonably <br /> designed to provide for the rehabilitation of the affected lands <br /> to the subsequent benefit use of such lands.
