.. , <br />Pre and Post Mining Land Use <br />You have indicated that the current land use is industrial/commercial and have <br />proposed a post mining land use of industrial/commercial. Please provide <br />specifics regarding the current land use; what sort of industrial/commercial <br />activities are taking place on the parcel? It is unusual to designate a site <br />that consists of an intermittently active stream channel for an industrial/ <br />commercial post-mining use, particularly if any of the site lies within the 100 <br />year flood plain. A more appropriate use might be wildlife habitat. Please <br />supply justification for an industrial/commercial use, or select a different <br />post mining land use which may be more appropriate to the site. The Colorado <br />Division of Wildlife should be consulted for input on the reclamation plan if <br />wildlife habitat is selected. <br />Ordinary High Water Line <br />If any portion of the permit area lies under the ordinary high water line, <br />these areas will require special attention. No stockpiles, equipment, or mine <br />facilities may be located below the ordinary high water elevation. The asphalt <br />plant, and any fuel, lubricating oil, anti-freeze, etc. stored up grade from <br />the ordinary high water elevation must be within a bermed storage area to <br />prevent spills from entering the drainage. <br />Exhibit F- Other Permits <br />The Colorado Department of Health, Water Quality Control Division began <br />enforcement of the storm water provisions of the Federal Clean Water Act on <br />October 1, 1992. All operators of privately owned mining operations will need <br />to apply for a Storm water National Pollution Discharge Elimination System <br />Permit (NPDES) from the Water Quality Control Division. Please contact the <br />Colorado Department of Health, water Quality Control Division at (303) 692-3590 <br />for details on how to apply for a storm water permit. <br />Please respond to each item contained in this letter prior to the November 2, <br />1992 decision date. If you are unable to prepare you responses in time to meet <br />the November 2, 1992 deadline, you must submit a written request for decision <br />date extension.
