Pursuant to C.R.S. 34-32-103(1) the <br />affected land does include roads. The operator submitted a geotechnical report from Western <br />Colorado Testing, Inc., that adequately demonstrated, to the satisfaction of the Division, that <br />the mining operation will not adversely affect the man-made stnrcture (the Becker residence) <br />that is within 200 feet of the affected land. From the information I have, the structure is <br />more than 31 feet from the affected land. The diagram showing the proposed tree planting <br />plan indicates the mining road is 125 feet from the Becker residence. <br />United Companies is committed to planting tines along the north boundary of the permit area <br />pursuant to the agreement entered into between the operator and Todd Richardson <br />(representative of the Beckets). I discussed the timing of the planting operdtions with <br />Paul McGehee, Untied Companies representative, in late May. Mr. McGehee said the trees <br />they want to transplant are currently in their spring growth phase and should not be <br />transplanted until late June. This will allow a better survival rate. <br />The work United Companies performed on the highway shoulders, and the highway itself, <br />comes under the jurisdiction of the Colorado Department of Transportation. If there are any <br />complaints regarding this operdtion you should direct them to the CDOT. <br />I did inform United Companies that it was not a good idea blocking an access road with their <br />equipment. I asked Paul McGehee to inform his employees that they not continue this <br />practice. <br />Finally, I am scheduling an inspection of the Colona Pit on June 14, 1994 as a result of your <br />complaint submittal. The only item we have jurisdiction of is the possible loss of topsoil due <br />to wind erosion. I will look at the operation to see if there are other items of interest or <br />non-compliance while at the site. <br />I hope I answered, or at least addressed, all of your concerns. I should reiterate if you have <br />a complaint about dust, contact the Department of Health.
