Since the Division has no jurisdiction in this matter I can <br />only ask the operator to comply with the agreement (if an agreement was entered into). <br />Normally, hours of operation are regulated by local zoning laws. <br />Both of you expressed wncerns about a dust problem. As I explained to Dorothy, also <br />Todd Richardson, dust emissions are regulated by the Department of Health. It is my <br />understanding that Todd Richardson contacted a Department of Health representative from <br />Grand Junction to complain about the dust problem. I would suggest, you and <br />Todd Richardson combine your efforts to resolve the complaint about dust by attempting to <br />get the Department of Health involved. <br />Both of you expressed concerns about removal and reinstallation of your mail boxes. Since <br />this is probably the jurisdiction of the post office, I suggest contacting the local post office <br />authority and lodge a complaint with them if they determine one is warranted. I instructed <br />United Companies to contact the post office and fmd out about mail box specifications. If <br />United Companies failed to reinstall the mail boxes to specifications I imagine postal <br />authorities will require them to fix the problem. Again, since the Division has no <br />jurisdiction in this matter we cannot force the operator to comply with federal statutes. <br />Pursuant to C.R.S. 34-32-115(4)(d), if the operator cannot adequately demonstrate that the <br />mining operation will not adversely affect the stability of any significant, valuable, and <br />man-made structures located within 200 feet of the affected land then the operator and <br />structure owner must have an agreement such that the operator will compensate the structure <br />COLORADO <br />
