<br />' LEGAL RIGHT TO ENTER 11/ls/66
<br />' SAND AND GRAVEL MINING LEASE
<br />THIS SAND AND GRAVEL MINING LEASE ("Lease") made and entered
<br />' into as of this ~ day of Naue.nber 1986, by and between
<br />BARBARA M. WHITE, JAMES WHITE, ROBERT S. CALVERT and the ESTATE
<br />' OF ELAINE K. CALVERT, deceased, together with their heirs, suc-
<br />cessors and assigns (hereinafter collectively referred to as
<br />"Lessor"), and READY MIXED CONCRETE COMPANY, a Colorado corpora-
<br />' tion, with offices at 4395 Washington Street, P.O. Box 2290,
<br />Denver, Colorado 80201 (hereinafter "Lessee").
<br />t RECITALS:
<br />A. Lessor is the owner of land described herein and is
<br />' willing to lease said lands to Lessee for mining purposes and
<br />building a ready mix concrete plant on the premises; and
<br />B. Lessee desires to enter into this Lease with Lessor for
<br /> the purpose of obtaining the right to conduct mining operations
<br /> and operate a ready mix concrete plant on the terms and condi-
<br /> tions herein.

<br /> AGREEMENT
<br />' 1. Grant. Lessor, for and in consideration of the sum of
<br /> Ten Dollars ($10.00), in hand paid, of the royalties herein pro-
<br /> vided and of the agreements of Lessee herein contai ned, hereby
<br />' GRANTS, DEMISES, LEASES and LETS exclusively unto Lessee the land
<br />hereafter described, for the purpose of investigating, exploring,
<br />drilling, digging and mining for, producing, saving, taking, own-
<br />' ing, transporting, storing, handling, crushing, separating and
<br />treating all sand, gravel, rock, topsoil and all other minerals,
<br />ores and mineable materials, whether similar or dissimilar and
<br />which occur as components thereof or in association therewith,
<br />' hereinafter "Gravel," together with all rights, privileges and
<br />easements useful for Lessee's operations hereunder on said land,
<br />including but not limited to the following rights: to build
<br />' roads, to construct tanks, pumps and power stations, power and
<br />communication lines, offices for its employees, ore treatment and
<br />processing facilities, mineral crushing and separating facili-
<br />' ties, and any other improvements, buildings, structures or facil-
<br />ities used or useful in a ready mix concrete operation. This
<br />Lease shall not give the Lessee the right to mine or explore for
<br />oil, coal, natural gas or other hydrocarbon substances. The land
<br />included in this Lease (hereinafter the "Property") iS situated
<br />in the County of Adams, State of Colorado, and is described as
<br />follows, to wit:
