<br />Construction Materials Permit to cover the additional area that had been disturbed. <br />Siloam Stone did obtain a valid I 1 1 Mining Permit (M-97-018) on July 7, 1997. In addition, <br />Siloam Stone submitted the required 112 application on September 30, 1997. This application <br />did address the corrective action issued as a result of the Notice of Violation, which was to <br />permit the entire area which was disturbed, however, Siloam Stone also decided to expand their <br />operations at that time to include approximately 320 additional acres of the state section lease. <br />The 112 application was called complete on October 6, 1997 and the original decision date was <br />set for January 5, 1998. An application is "complete" when it includes some very basic <br />administrative items such as a completed application form, the required fee, and the required <br />exhibits. The last date for public comment was November 21, 1997. Two objections to the <br />application were received within the public comment time frames. <br />The first was received on November 12, 1998 from Red Creek Ranch, the majority surface land <br />owner within the proposed permit azea. The second was received on November 21, 1997 from <br />Kelly Pazk, who also owns surface property within the proposed permit azea. Copies of both of <br />these objections aze attached to this memo. The office also received comments from the State <br />Engineers Office, Department of the Army, and San Isabel Electric Assn. All of these parties <br />were notified of the informal conference and only Kelly Pazk and Joe O'Brien of Red Creek <br />Ranch attended the informal conference which was held on December 15, 1997 in Pueblo. <br />The preliminary technical adequacy review letter was sent to Siloam Stone on December 23, <br />1997. A technical adequacy review is performed on every application to ensure that the <br />application meets the minimum requirements of the Act and Regulations. Due to the complexity <br />of responding to the adequacy issues, Siloam Stone requested an extension of the decision date <br />until January 9, 1998 and once again until January 12, 1998. Upon receiving the responses, the <br />Division staff made a decision to recommend approval, with stipulations, to the Mined Land <br />Reclamation Boazd (see attachment). <br />Since there are objections to this application, the Division was required to hold aPre-Board <br />Hearing to identify the parties which will be represented at the formal public heazing and to <br />determine what the issues aze concerning approval of this application. The Pre-Boazd Hearing <br />was held on January 23, 1998. Just prior to conducting this hearing, several additional letters of <br />objection were received by the Division. The hearing officer determined that these letters had <br />been received outside of the appropriate public comment time frames and could therefore not be <br />considered as part of the evidence or testimony during the formal Boazd Hearing. However, the <br />officer ruled that these objectors would have an opportunity to address the Board during the <br />public comment portion of the heazing.
