Long <br />Division Director <br />RE: Rowe Gravel, File No. M-99-038, Application Preliminary Adequacy Review <br />Dear Mr. Rowe: <br />The Division has reviewed your application for a Reclamation Permit for the Rowe Gravel site. <br />The following adequacy comments detail additional information that must be submitted before the <br />Division can approve your application. Please submit your response as soon as possible, but no <br />later than September 14, 1999 so the decision due date of September 16, 1999 can be met. <br />Please be aware that, if your responses are not received by September 14, 1999, the application <br />may be denied resulting in re-instatement of the full 537,379.00 civil penalty ordered by the <br />Mined Land Reclamation Board at the May 26, 1999 Board Hearing. I will be out of the office <br />from September 6`h through the 10'h. If you have any questions regarding this review, please <br />contact any other staff at our Durango office. (Tom Gillis - 247-5523). <br />ADEQUACY COMMENTS <br />Application Form <br />1. Please revise item no. 9 on the application form to indicate the quarter section as the NE <br />quarter, not the NW quarter. Also, it is the 10th Principal Meridian, not the 6'h. <br />Exhibit A - LeaalExhibit Description <br />2. The legal description should indicate that the center of the operation is located in the <br />SW/4SE/4NEl4 of section 16, T33N, R12W, N.M.P.M. <br />3. The statement about the adjoining landowner states that Susan Warner owns property to the <br />southeast of the pit. However, the maps indicate that Steve and Susan bass own this <br />property. Please correct this discrepancy. <br />Exhibit B -Site Description <br />4. Please provide a description of water resources in the area of the operation. Include pond size <br />and use and include a description of the Church Hollow drainage, i.e.: type of stream <br />(ephemeral, intermittent, seasonal, etc), and provide any water quality and quantity data <br />available. This information may be available at the Colorado Division of Water Resources <br />office. Also, please provide the elevation of the groundwater table at the site location. <br />
