PART I <br />Page le of 19 <br />Permit No. CO-0032115 <br />A. TERMS AND CONDITIONS <br />2. Burden of Proof Requirements (continued) <br />Should a precipitation event or snowmelt occur, the permittee shall submit adequate <br />proof in order for an exemption to be claimed. Said proof shall be submitted as an <br />attachment to the Discharge Monitoring Report (DMR) for the appropriate period. The <br />Division shall determine the adequacy of proof. As part of this determination, the <br />Division shall evaluate whether the permittee could have controlled the discharge in <br />such a manner that primary limitations could have been met. All manual dewatering <br />of the ponds shall meet TSS and total iron limitations. <br />3. Post-Hinin¢ Areas <br />Commencing at the time active mining has ceased and surface areas have been returned <br />to the required contour and revegetation has begun, all applicable discharges may be <br />eligible for limitations other than those specified in Parts I.A.1. These <br />post-mining limitations shall remain in effect until bond release. The permittee <br />shall notify the Division upon cessation of active mining so that consideration of <br />appropriates permit modifications can be made. <br />4. Salinity Parameters <br />In order to obtain an indication of the quantity of Salinity being discharged from <br />the site, t:he permittee shall monitor the wastewater effluent at the following <br />frequency: <br />Outfalls Frequencv Sample Type <br />001, 002, 003, 005, 006, 008, 009, 010, Quarterly Grab <br />011, 012, 013, 014 and 015 ' <br />5. Best Management Practices - 001. 002. 005 <br />For the pH variance, as listed in Part I.A.1. to be in effect, the permittee must be <br />taking all reasonable measures to reduce the pH, including the use of a COp bubbler <br />at the outfall(s). Documentation of such shall be submitted with the applicable DMR <br />any time a pH level of over 9.0 s.u. is reported. <br />The permittee may develop other appropriate measures to control pH, such as the use <br />of appropriate algic ides, aquatic life, etc. However, such measures in addi[ion to <br />or instead of the COZ bubbler must be approved by the Division via a permit <br />amendment prior to their use. <br />B. MONITORING REQUIREMENTS <br />1. Frequencv and Sample Tyoe <br />In order to obtain an indication of the probable compliance or noncompliance with <br />the effluent limitations specified in Part I.A.1, the permittee shall monitor all <br />effluent parameters at the following frequencies. Such monitoring will begin <br />immediately and last for the life of the permit unless otherwise noted. The results <br />of such monitoring shall be reported on the Discharge Monitoring Report (See Part <br />I.B.3.) <br />Amendment 2 Issued Effective <br />See Part I.C. for Definitions. <br />
