'Ihe absence of suitable alternative sites which would <br />allow these ponds to perform their required regulatory function necessitated the <br />existing aryl proposed detention basin locations. f~hemeral tributaries to Foidel <br />and Middle Creek have been fourrl by field P+~m~*+~tion not to meet the criteria <br />of Rule 4.05.18 (3) and buffer zones have not been planned for these ephemeral <br />drainages. <br />Given that Mine 3 is in final reclamation, CYCC feels that buffer zone signs are <br />neoe~sary only in the area of the Middle Creek Office, the only remaining area <br />to be reclaimed. Zherefore, as di ^s.,.._=sa with the MLRD, buffer zou~e signs are <br />being maintained only in the area of the Middle Creek office at this time. <br />Agricultural equipment used for hay cropping does operate within the buffer zone, <br />but this is not a mining related activity. <br />Zhe aooPss road presently located in the NF1;, NE; section 13 T5N, R86W is <br />within 100 feet of Middle Creek, but does not cross the stream charurel. Desicyr <br />aryl construction of the haulroad were oo~leted prior to the promulgation of the <br />Surface Mining Control and Reclamation Act of 1977 (P.L. 95-87), consequently, <br />the access road does not conform to the specifications stipulated order Rrle <br />4.03.2 of the Regulations of the Colorado Mined Land Reclamation Board for Coal <br />Mining. However, the aooess road will be maintained, repaired, and reclaimed in <br />accordance with the rer~»*~*+*s of Rule 4.03.2. Drainage designs for all <br />existing and prl roads are described in detail under 13r1e 2.05.3(3).
