once with §37-90-137(11), C.R.S. subject to the following conditions:
1. This plan shall be valid through July 10, 2009 unless otherwise revoked or
modified. If this plan will not be made absolute by a water court ;action by the
plan's expirationdate, arenewal request must be submitted to tYiis office with the
statutory fee (currently $257) by May 25,2009.
2. A well permit must be obtained for the gravel pit in accordance with §37-90-137(2)
and (11), C.R.S.prior to exposure or use of groundwater. Any application will be
evaluated subsequent to approval of this plan. The provisions of` §37-90-137(2)
prohibit the issuance of a permit for a well to be located within 6Ci0 feet of any
existing well, unless the State Engineer finds that circumstances so warrant after a
hearing in accordance with the procedural rules in 2CCR402-5. The hearing will
be waived if you Tare able to obtain statements from the owners of all wells within
600 feet, verifying that they have no objection to your use of the Ixoposed well.
Should a new well permit be denied for reasons of the 600 foot spacing, or any
other legitimate reason, approval of this amendment will be canceled.
3. Anew lease for augmentation water must be provided for the period April 1, 2008
through July 10, 2009 prior to the expiration of the current lease.
4. The water consumption and depletions associated with this mining operation must
not exceed those amounts listed on the attached Table 3. The total area of
exposed groundwater shall not exceed 1.1 acres. Documentation of pond size
may be required iby the Division Engineer in the form of an aerial photo evaluation
or survey by a P ~ofessional Land Surveyor during the plan year cr in subsequent
years covered by renewals of this plan.
5. Approval of this plan is for the purposes as stated herein. Any additional uses of
this water must first be approved by this office.
6. All pumping for dust control shall be metered, with meter reading s reported to the
Water Commissioner and Division 2 office. The proposed accounting form should
be ri:vised to include the meter readings.
7. The Water Commissioner responsible for the administration of this plan is Mr.

539-3833. The applicant shall maintain daily records of all diversions,
replacements, and the amount of water used for each particular frurpose. The
