A well permit must be obtained for the gravel pit in accordance with §37-90-137(2) <br />and (11), C.R.S.prior to exposure or use of groundwater. Any application will be <br />evaluated subsequent to approval of this plan. The provisions of` §37-90-137(2) <br />prohibit the issuance of a permit for a well to be located within 6Ci0 feet of any <br />existing well, unless the State Engineer finds that circumstances so warrant after a <br />hearing in accordance with the procedural rules in 2CCR402-5. The hearing will <br />be waived if you Tare able to obtain statements from the owners of all wells within <br />600 feet, verifying that they have no objection to your use of the Ixoposed well. <br />Should a new well permit be denied for reasons of the 600 foot spacing, or any <br />other legitimate reason, approval of this amendment will be canceled. <br />3. Anew lease for augmentation water must be provided for the period April 1, 2008 <br />through July 10, 2009 prior to the expiration of the current lease. <br />4. The water consumption and depletions associated with this mining operation must <br />not exceed those amounts listed on the attached Table 3. The total area of <br />exposed groundwater shall not exceed 1.1 acres. Documentation of pond size <br />may be required iby the Division Engineer in the form of an aerial photo evaluation <br />or survey by a P ~ofessional Land Surveyor during the plan year cr in subsequent <br />years covered by renewals of this plan. <br />5. Approval of this plan is for the purposes as stated herein. Any additional uses of <br />this water must first be approved by this office. <br />6. All pumping for dust control shall be metered, with meter reading s reported to the <br />Water Commissioner and Division 2 office. The proposed accounting form should <br />be ri:vised to include the meter readings. <br />7. The Water Commissioner responsible for the administration of this plan is Mr. <br />Bruce Smith, 10,000 Cheyenne Circle, Salida, Colorado 81201, F~hone no. (719) <br />539-3833. The applicant shall maintain daily records of all diversions, <br />replacements, and the amount of water used for each particular frurpose. The <br />
