Sherman <br />Ezacutiva Director <br />(Vacant) <br />State Engineer <br />This letter is in response to the application submitted October 30, 2006 requesting a <br />substitute water supply plan (SWSP) for a sand and gravel pit to be operated by Pelino <br />Excavation, Inc. ("Applicant") in accordance with Section §37-90-137(11), C.R.S. The applicant <br />shall be responsible for compliance with this plan, but the State Engineer's Office may also , <br />pursue the landowner for eventual compliance. The required fee of $1,593 for the substitute <br />water supply plan has been paid. <br />Plan of Operation <br />This plan describes the proposed water consumption for the period of January, 2007 <br />through July, 2009. Up to 1.1 acres of groundwater may be exposed within the permit area. <br />Depletions <br />You have provided a monthly breakdown of the annual depletions at this site in your <br />attached Table 3. The table shows that during the period of January 2007 through July 2009 the <br />total stream depletions are estimated to be 13.78 acre-feet. These depletions have been lagged <br />to the Arkansas River. The estimated depletions are based upon groundwater evaporation, <br />water in mined product, and dust control. No groundwater will be used for concrete production, <br />reclamation, or any other purpose. The proposed mining operation will not include mining below <br />the water table unless an amendment to this SWSP is approved by this office. No ground water <br />was exposed within the permit boundary prior to January 1, 1981. No phreatophyte credit has <br />been applied to this plan. <br />Replacement <br />The proposed source of replacement water for this pit is a lease of consumable water <br />from the Upper Arkansas Water Conservancy District's Twin Lakes Reservoir and Canal <br />Company water in the amount of 6.18 acre-feet.
