Cattany <br />Division Director <br />Natural Resource Tmstee <br />Listed below aze adequacy review comments on the above-captioned Regulaz 112 Application. The <br />decision date for your application is scheduled for June 7, 2004. Therefore, I would appreciate a response <br />from you on or before May 19, 2004. (Your response should include two (2) copies). Any comments that <br />we receive on your application during the public comment period will be forwazded to you. Please be <br />advised that your application maybe deemed inadequate and maybe denied on June 7, 2004 unless the <br />following adequacy review items aze addressed to the satisfaction of the Division. <br />6.4.4 EXHIBIT D -Minim Plan <br />1. The applicant has specified that where excavation occurs within two hundred (200) feet of a permanent <br />man-made structure such excavation will occur at the final slope configuration (ie: 3:1) so as to eliminate <br />any chance that these structures will be affected by mining. Accordingly, this specification will become an <br />enforceable component of the mining and reclamation plan and must be adhered to at all times throughout <br />the life of the operation. Please respond. <br />2. The applicant has specified on page 12 that the average depth of salvageable topsoil is 6 to 8 inches and <br />the average depth of overburden is 24 to 60 inches. Based on the total disturbance expected (33.39 acres) <br />and the acreage of existing disturbance (5.05 acres) it appears there will be 28.34 acres to be stripped of <br />salvageable topsoil and of overburden. Please verify if this acreage is correct. If not, please clarify the <br />acreage to be stripped of topsoil and of overburden. <br />3. In conjunction with Items 2 & 4, please quantify the maximum volume of overburden, inert materials, <br />and of topsoil to be stockpiled at any one time. <br />4. The applicant has stated on page 12 that some imported inert material will be imported fcr recycling <br />purposes and that some of the excess inert material may be used as fill in the slopes. Prior to importation <br />and backfilling of such materials, the applicant will need to demonstrate requirements (a) through (f) of <br />Rule 3.1.5(9).
