Board of County Commissioners, Douglas County <br />February 8, 2001 <br />Page Two <br />comprehensive waste screening program will be practiced during all hours of operation. The landfill <br />will have a capacity of approximately 10,000,000 cubic yards and an estimated site life of 23 years. <br />In accordance with the solid waste statute, CRS 30-20-100.5 et seq. (the Statute), and the corresponding <br />regulations, 6 CCR 1007-2 (the Regulations), CDPHE issued a press release about the proposed <br />operation and held a 30-day public review and comment period. The only comment letter received was <br />from Douglas County Planning Division, who stated that the proposed landfill would require a Use by <br />Special Review permit in addition to the Certificate of Designation. Douglas County Planning Division <br />also expressed concern about the compatibility of the landfill operation with clay mining activities <br />permitted for the property. <br />In this final report on our comprehensive technical review, CDPHE has the following technical <br />conditions of approval to be incorporated as requirements in the Certificate of Designation, which is <br />now required by Section 104(2)(a) of the Statute, should one be approved by Douglas County: <br />The site and facility shall comply with the health laws, standards, rules and regulations of the <br />Department, the Water Quality Control Commission, the Air Quality Control Commission, and <br />all applicable local laws and ordinances. <br />2. As the site is a property permitted for mining by the Division of Minerals and Geology (DMG <br />permit M-79-221), the property owner is to furnish documentation that planned recycling and <br />disposal operations at the site are compatible with requirements of DMG and the lease holder. <br />Only Construction and Demolition Debris and Inert Materials are [o be accepted and disposed at <br />the facility. Acceptance of any other waste would require review and approval by Douglas <br />County and CDPHE. <br />4. Financial Assurance in accordance with Section 1.8 of the Regulations will be required for the <br />landfill, landfill systems, and all structures and facilities not related to [he mining operation. <br />The facility will be an attended solid waste disposal site, and as such, it is subject to collecting <br />and remitting to CDPHE the quarterly Hazardous Substance Response Fund fee, which is <br />imposed under Title 25, Article 16, Section 101 et seg of the Colorado Revised Statutes, as <br />amended. An information package and forms will be provided to the operator. <br />It is the assessment of the Division that dre proposed facility can comply with the technical, <br />environmental and public health standards of the Statute and the Regulations if the facility is constructed <br />and operated as detailed in the submitted plan and with the requirements of CDPHE, as stated in this <br />
