<br />Commissioner Leinsdorf made the motion to approve the <br />Schmalz gravel pit application for two acres, less than 10,000 <br />tons per year, and less than 180 days per year be classified as a <br />development of minor impact on the additional grounds that there <br />be no substantial unmitigated conflict with County land use <br />policies, no substantial demand for governmental funds if the <br />mitigating measures are employed, and on specific finding that <br />the proposal be compatible with the surrounding land uses which <br />at present are undeveloped. Further the County imposes the <br />following conditions: <br />1. Applicant take appropriate measures to be <br />monitored by the County to apply an approved dust <br />retardant to the haul road to minimize any <br />fugitive dust from the haul road. <br />2. Applicant take measures to guarantee restitution <br />to the County for damage to County Roads #17 and <br />#18, or whichever is used for access, to <br />compensate the County for any road damage. <br />3. The condition that there be no batch of any kind <br />on the site. <br />4. No hauling will be done from the location during <br />morning or afternoon school hours. <br />5. Truck turning signs are installed at the <br />intersection with Highway #50 frontage road. <br />6. That present operation be confined to two acres <br />which will include the distrubed areas, staging <br />areas, stockpiling areas, spillage areas, <br />crushing areas, excavated areas, everything will <br />be confined to the two acres except the haul <br />roads will not be included in the two acres. <br />7. That at the intersection of County Road #17 and <br />Highway #50 frontage road all trucks will have to <br />make a right turn to access Highway #50, they are <br />not to make a left turn out on the frontage road. <br />8. That the middle of the three access roads from <br />the gravel pit will be employed between the <br />gravel pit and County Road #17. <br />9. In the event that State or Federal law requires <br />the suspension of operations if artifacts are <br />found on the property the applicant will comply <br />with the regulations. <br />Commissioner Field seconded the motion. Vote was <br />unanimous. <br />
