• compliance with both the Federal Clean Water Act and the Colorado Water <br />Quality Control Act. A detailed discussion of hydrologic control and <br />mitigation measures is presented in Section 2.05.6, Mitigation of Surface <br />Mining Operation Impacts. <br />Compliance with applicable air quality regulations is effected by <br />operational control and mitigation measures and operation under the <br />provisions of air emissions permits issued by the Colorado Department of <br />Health. EFCI does not operate any point source generators, consequently <br />any air emissions are limited to fugitive dust emissions from surface <br />refuse disposal operations, crushing and coal preparation activities, and <br />coal stockpiling and reclaim activities. EFCI has not experienced any <br />significant problems with fugitive dust emissions from any mining or <br />related operations. The primary controlling factor is the significant <br />percentage of surface moisture in coal and refuse materials which limits <br />potential dust emissions. In addition, all coal processing activities <br />• involve wet processing so dust generation is not a problem. <br />Over the life of the Southfield and previous Dorchester operations, the <br />mine has maintained a record of effective compliance with applicable <br />provisions of existing air quality permits. To date, there have been no <br />violations of applicable air quality standards, and ongoing permit <br />compliance under State air emission permits meets the specific <br />requirements of the Federal Clean Air Act and Colorado Air Pollution <br />Control Act. <br /> <br />2.05.4-31 <br />
