On August 7, 1980, the Colorado Department of Health - Air
Pollution Control Division, Denver, Colorado, advised Kerr
Coal that the Division would prefer that Kerr Coal submit new
emissions permits rather than amendments to the existing
permits. However, the Division also advised Kerr Coal that,

pending approval of the emissions permits, Kerr Coal would be
permitted to increase its production to 850,000 tons per year.
On the basis of this assurance, Kerr Coal submitted the follow-
ing emissions permit applications:
1) Emissions Permit Application - Surface Mining Activities:
submitted as of July 25, 1980 - approval pending;
2) Emissions Permit Application - Coal Handling Activities,
including raw coal storage and railcar loading: sub-
mitted as of July 25, 1980 - approval pending;
3) Emissions Permit Application - Feeder Breaker, Double
Roll Crusher, Transfer Stations and Screening: submitted
as of July 25, 1980 - approval pending.
On October 15, 1980, the Division advised Kerr Coal that no prob-
lems had been identified in connection with the above applications
and that approval could be expected on or before January 15, 1981.
