C~ <br />• <br />606412 10/19/1993 03:45P B: B74 R: B6B <br />AUDREY BREKEL, CLERK 8 RECORDER, LOGAN COUNTY CO <br />SURFACE RIGHTS OF LESSEE <br />Lessee may clear brush and undergrowth from such portions of the leased <br />premises as may be reasonably necessary to explore for materials or to locate <br />pits, quarries, and stockpile areas. In order to obtain access to the leased <br />premises and to carry on its operations hereunder, lessee shall have the right <br />to make use of all roadways presently existing on the leased premises and shall <br />have the further right to build such additional roads as may be necessary for <br />the production and removal of materials hereunder. In building such roads, lessee <br />may use materials from leased area and lessee shall not be required to pay <br />royalties to lessor for materials so used. <br />Lessee may erect a plant or plants on the leased premises, if it should <br />so desire, to process materials thereon. Lessee may also erect such buildings <br />and install such machinery and equipment as may be useful in connection with <br />its operations hereunder. <br />Lessee shall have the right to drill water wells on the leased premises <br />for use in connection with mining operations thereon. On permanent cessation <br />of the use of any such well, or on termination of this lease, lessee shall leave <br />such well and the casing therm for the use of lessor, but lessee may remove any <br />pumps or motors. <br />DAMAGE TO LIVESTOCK, CROPS, AND IMPROVEMENTS <br />Lessee will repair any damage done to water wells, drinking troughs, storage <br />tanks, and other similar improvements on the leased premises, and lessee will <br />pay the reasonable value of any livestock and crops that may be killed, injured, <br />destroyed, or damaged by lessee's agents or employees. <br />PROTECTION OF PREP1ISES <br />Lessee agrees to provide and install adequate gates and cattle guards at <br />all entrances into areas of the leased premises being used or occupied by lessee. <br />Such gates will be kept locked during the hours of darkness and at all times <br />when such areas are not occupied by lessee's personnel. <br />PROTECTION AND RESTORATION OF SURFACE <br />In digging pits for the purpose of producing and removing materials here- <br />under, lessee agrees to make separate stockpiles of topsoil and of waste substances. <br />Lessee agrees that on completion of the removal of materials from pits that have <br />been dug on the leased premises, lessee will place any unused waste substances and <br />materials used for roadways back into the pits from which such substances and <br />materials were removed, with topsoil placed on top, and that lessee will back- <br />slope such pits, using such substances and materials as have been removed from <br />such pits. <br />Before termination of the lease, lessee agrees to plow, level, and re-sod <br />with grass all areas where roads and stockpiles have existed. <br />-2- <br />
