Lindstrom , <br />hereinafter referred to as Lessor, and BOARD OF COUNTY COhIP1ISSI0flERS OF LOGAN <br />COUNTY, COLORADO, hereinafter referred to as Lessee. <br />WITNESSETN: <br />Lessor, in consideration of the agreements set forth herein to be kept <br />and performed by lessee, and of the payment of the royalties by lessee as <br />provided herein, and subject to the terms, conditions, and provisions contained <br />herein, leases to lessee that certain tract of land situated in Logan County, <br />Colorado, which is described in Exhibit A attached hereto and made a part hereof, <br />for the purpose of quarrying, mining, removing, marketing, and using therefrom <br />all sand, gravel ,and rock, all of which are herein referred to as materials. <br />TERP4 OF LEASE <br />This lease shall be in effect for a period of five (5) year(s) <br />from the 19th day of October 19 93 to the 19th day of Octo <br />19 98 -- - <br />ROYALTIES <br />Lessee shall pay to lessor, as royalty twenty-three cents ($•23) per yard <br />for each cubic yard of materials removed from the premises under the direction <br />of the lessee or by lessee's permission. Said royalty shall be adjusted upward <br />or downward in the event Lessee is paying more or less to other lessors for such <br />material. The quantity shall be determined after the materials are loaded in <br />trucks. Said sum shall be payable within 30 days of the determination of the <br />amount payable. <br />Lessee shall forward to lessor monthly reports showing the quantity of <br />materials removed during the preceding mohth, according to load tickets, with <br />dates of loading. Such reports shall be forwarded to lessor by the loth day <br />of the month following any month in which materials are removed. It is under- <br />stood that during certain months of the year it may be impracticable to remove <br />materials because of weather conditions; no report shall be required for any <br />month during which no materials have been removed. <br />Lessee agrees to keep a strict and accurate record of all materials <br />removed from the leased premises and all sales thereof, and lessor shall have <br />the privilege at reasonable times of examining the mining procedures and checking <br />the books and records of lessee for the purpose of verifying the amount of <br />royalties payable. <br />Exhibit - G <br />Source of Legal <br />Right-to-Enter <br />
