Crace shall have the right in good faith to contest <br />any of the above taxes and assessments, whether payable by <br />Crace or payable by Christy, but shall not permit or suffer <br />the Coal to be sold at any time for such taxes and assessments. <br />6. Conduct of Operations. Crace shall exercise <br />its rights under this lease upon the following terms: <br /> (a) Liens and Encumbrances. Crate shall keep <br /> the title to the Coal free and clear of liens and <br /> encumbrances resulting from its operations hereunder, <br /> provided that Grace may refuse to pay any claims asserted <br /> against it which it disputes in good faith. Grace shall <br /> contest any suit commenced to enforce such a claim, and, <br /> if the suit is decided against Grace, it shall promptly <br />C• pay the judgment. <br /> (b) Indemnity and Insurance. Grace agrees to <br /> indemnify Christy and save him harmless from and against <br /> any loss, liability, expense or damage he may incur to <br /> third persons or corporations for injury to or death of <br /> persons or damage to property which is a direct result <br /> of Crate's operations under this Mining Lease. Prior to <br /> ~ the commencement o£ mining operations hereunder, Grace <br /> shall provide and keep in force during the term of this <br /> Mining Lease general liability insurance issued in the <br /> names of Grace and Christy which shall have minimum <br /> limits of liability of 5100,000 for each person injured <br /> and 5100,000 for each accident and shall also comply <br /> with applicable Colorado workmen's compensation laws and <br /> will furnish Christy copies of said policies. <br /> (c) Inspection. Christy or his duly appointed <br /> representative shall have the right, exercisable at all <br /> reasonable times and in a reasonable manner so as not to <br />-3- <br />
