Sigmt mul C'enificatinn REYluirement. <br />a. Al! reports and other information required by tfie Division, shall be signed and certified for accuracy by the penuiuce in <br />accord with the follo+ving criteria: <br />(1 } !n the case of corporations, by: a principal executive officer of at least the level of vice-president br his or her drily <br />authorized representative, if such representative is responsible for the overal3 operation of the facility from +vhich the <br />discharge described in the fomt originates; . <br />(2) . !n the case of a partnership, by a general partner;. • <br />(3) In the case of a sole proprietorship, by the proprittor; <br />(~) In the case of a municipal, state, or other public facility, by either a principal executive officer, ranking elrcted otlicial. <br />or other drily authorized employee, . <br />b. All reports required by pemtits, and other infomtation requested by the Division shalt be signed by a person as described <br />above or by a duly authorized representative of that person. A person is a duly authorized representative only i F. <br />(1) The anthorizatitin is made in writing by a Ix~son described above; <br />(2) The authorization specifies either-an individual or a position havin5 respansibility for the overall operation of the <br />regulated facility or activity such as the positron of plant ntantiager, operator of a +vetl or a well field, superintendent, <br />posititm of equivalent responsibility; or an individual or position having overall responsibility for etivironntental matters <br />for the company. (A duly authorized representative may thus be either a named indrviduai or anyindi~•idual occupying <br />a named position): and, <br />(3) The written- authorr~alron is submitted to the Divisron. <br />If an authom~tion as described rn thrs section is no larger accurate because a different individual or position has <br />responsrbility for the overall operation of the facility, a new authorization satisfying the cequiremc~tus of this section mutt be <br />submitted to the Division prior to or together with any reports, htfotmation, or applications to be signed by an authoiizcd <br />representative. <br />The pemtittee, or the duly authorized representati+•e shalt make and si ~n the folloa•im: certification on all such documents: <br />"I certify under penalty of law that thrs document and all attachments were prepared under my direction or supervision in <br />accordance with a system desri;tted to assure that yuaGfied personnel properly gather and evaluate the infomtation submitted. <br />Based on my inquiry of the person or persons who ntana~c the system, or those persons directly responsible for gathering <br />the infnmtation, the information submitted is to the txst of my kno+yledge and belief, true, accurate. and complete.
