IIect ~;inmgement Pr~eticec <br />the pennttee shall take all reasonable precautions to prevent any point source discharge into surface waters al the State <br />except as authorized through the temts and conditions that have been assigned tv specific discharge points that hate bctn <br />identified in the permit. The pennittee shall ensure drat the excavation, movement and placement of <br />arty materials that niigltt be contaminated with cyanide or other environnteittal pollutants is carried art in a titunoer which will <br />at'oid any discharge of pollutant's to surface waters of the State. <br />3. <br />The pennittee shalt achieve compliance with the final effluent limitations of Part [.A.1. for potcntiatly dissolved cadmium and <br />copper metals effeciive Febntary 1, 2006, in accordance with a schedule oC compliance approved by the Division. Phis <br />schedule of compliance applies to otttfall 001 A. <br />The pennittee shall submit to the Division by February 1, 2004, an implementation plan for achieving compliance fur the <br />aforementioned studies. As appropriate, the plan shall include operational changes, modification of the existing treaumnt <br />system, pretreaanent, and'or crntstrucuon of a flew [rcatinent system. A schedule of dates to accomplish various tasks related w <br />the plan should also be included. <br />Upon approval of the implementation plan(s) b}• the Division, all temts and eonditiotu of the implententationptan(s), including <br />but not hnvted to the compliance schedule, shall automatically become conditions of this petntit. <br />No later than 14 calendar days Collow'ing each date identified in the above schedule of compliance, the permitter shall submit <br />either a report of prograss or, in the case of specific actions being required by identified dates, a written notice of compliance or <br />noncompliance, any remedial actions taken, and the probability of meeting the next scheduled requirement. <br />The petmittee may petition to reopen the permit in response to any of the studies or reports required in the pemmit, or as oilier <br />information becomes available concerning the nature of the discharee and'or regulated contaminmtts, and'vr chan~ v> in <br />analytical methods (and guidance) used in detenninin+~ compliance" <br />The pemtittee will monitor for total mercury using the approved EPA methodolacy Method 1631 far a period lung coon ~h to <br />gather fvur samples. tf the concentrations are below detection or below the water quality stmtdard, monitorin+, Wray cease. If <br />howeycr, reportable concentrations aie present, monitoring wilt continue. <br />
