RESPO\'SIBILIl'IES (continued) <br />]'_1, C'nn firlentiality <br />Pcrtnit ~;o.: CU-nUJiG-tR <br />Any infotntation relating to any secret process, method of manufacatre or production. or sates or marketing data which has been <br />declared confidential by the permittee, and which may be acquired, ascertained, or discovered, whether in any sampling <br />investi~*ation, emergency tnvesttgation, or o[henvise, shall not be publicly disclosed by any member, officer, or employee of the <br />Comnnsston or the Division, but shall be kept confidential. An person seeking to ineoke the protection of this Subsection (12) <br />shall bear the burden of proving its applicability. Tf»s section shall never be interpreted as preventing full disclncure of efflnt~^.! <br />data. <br />13. Eet:s <br />The pennittee is required to submit payment of an annual fee as set forth in the 1983 amendments to the Water Quality Control <br />Act. Section 25-8-502 (1) (b}, and-the Colorado DischarS>e Permit System Regulations 5 CCR 1002-b1, Section 6L15 as <br />amended. Failure to submit the required fee when due mid payable is a violation of the pemtit and wilt result in rnfitrcrment <br />action pursuant to Section 25-8-601 et. seq., C.R.S. 1973 as amended. <br />1.7. S)nratio__n nf~;rrnit <br />The duration of a permit shall he for a fixed tettn and shall not exceed five (>) years. Filing of a timely and cumpic•tc <br />application shall cause the expired permit to continue in force to the effective date of the new• pemtit. A pemtit may nut be renewed, reissued, or nwdified to contain effluent limitations adapted pursuant to Section 2>-~- <br />503{1)(h) (BPJ} of the Water Quality Control Act, which arc less strin_ent than the comparable eftlucm limitations ur <br />standards in the previous permit. mtless any unc of the following exceptions is met and the conditions of paragmph (c? of <br />this section are met <br />i Material and substantial alterations or additions m the permitted facility otturred alter pcnnit issuance which justify the <br />application of less strinsent effluent limitations, or <br />ii. Infarntation is available which was not available at the time of pcnnit issuance (other than revised rcgu4atirn)>. <br />antidance, ur test methods} and which would have justified the application of a less stringent effluent limitation or <br />standard at the time of pcnnit issuance: or <br />iii. The Division determines that technical mistakes or mistaken interpretations of law were made in issuing the permit. <br />which justified relaxation of the etlluent limitations or standards; or <br />iv.
