Page 3 <br />Mr. Self <br />September 5, 1979 <br />This action by the Division is a decision based solely on the technical <br />merits of the plan and does not address other procedural requirements <br />which may be related to OSM's cessation order. This letter is not <br />intended to bias that process in any way. 41e would strongly recommend <br />that Empire take the appropriate steps to gain the necessary federal <br />approvals prior to proceeding with further construction activity. <br />As you are aware, several parts of the Eagle Mine Complex remain un- <br />permitted at this time. We will expect Empire Energy to make significant <br />progress in properly permitting the entire facility and would suggest <br />submission of a revised plan by October 17, 1979• Hopefully the experience <br />gained in the preparation of the silo documents will lead to an equally <br />efficient process with respect to the entire permit application. <br />We will appreciate the continuing cooperation of Empire Energy and its <br />representatives as we move toward a proper resolution of all issues <br />surrounding the Eagle Mine Complex. <br />Sincerely, <br />Hamlet J.
