Bax 68 ~~ - cw+lc, coi.aruso siezs <br />Craig, Colorado 81625 ~- <br />Re: Silo Re uest for A ~'~+ <br />q pproval to Construct Coal Silo-Loadout ;~ <br />File Number 76-7 -: <br />Dear Mr. Self: J <br />i <br />On August 10, 1979, Empire Energy submitted detailed plans outlining <br />their proposal to resume construction of and eventually operate, a <br />mine and silo loadout facility adjacent to the Eagle Mine Complex .. <br />in Moffat County. Additional information was submitted on August 22nd, <br />a 23rd and 28th, 1979 pursuant to specific requests by the agency and the <br />Office of Surface Mining. A technical review of those documents indicates <br />that the silo has not been constructed in the optimum location, given <br />all the environmental considerations of its proximity to the Williams <br />fork River. However, this office has concluded that the plans referenced <br />above will provide the necessary degree of environmental protection and <br />as such, finds the proposal to be acceptable with the additions of the <br />stipulations listed below. Under the Board decision of August 21, 1979, <br />a bond in the amount of $515,000.00 must be submitted prior to resumption <br />of construction activities. i <br />t <br />PROPOSED STIPULATIONS FOR EMPIRE ENERGY: <br />1. The riprap program, proposed under a nationwide general permit, is <br />sufficient for temporary hank protection. However a more extensive <br />bank stabilization program needs to be developed. Empire Energy <br />should meet with the appropriate regulatory agencies to develop a <br />complete bank stabilization and maintenance program. This program <br />must be implemented before spring runoff. <br />2.
