Additional information was submitted on August 22nd,
a 23rd and 28th, 1979 pursuant to specific requests by the agency and the
Office of Surface Mining. A technical review of those documents indicates
that the silo has not been constructed in the optimum location, given
all the environmental considerations of its proximity to the Williams
fork River. However, this office has concluded that the plans referenced
above will provide the necessary degree of environmental protection and
as such, finds the proposal to be acceptable with the additions of the
stipulations listed below. Under the Board decision of August 21, 1979,
a bond in the amount of $515,000.00 must be submitted prior to resumption
of construction activities. i
t
PROPOSED STIPULATIONS FOR EMPIRE ENERGY:
1. The riprap program, proposed under a nationwide general permit, is
sufficient for temporary hank protection. However a more extensive
bank stabilization program needs to be developed. Empire Energy
should meet with the appropriate regulatory agencies to develop a
complete bank stabilization and maintenance program. This program
must be implemented before spring runoff.
2. The location of the primary sediment control pond (5-Pl) within
the 100 year floodplain makes it susceptible to stream erosion.
Empire Energy should propose] measures to protect the sediment pond
from erosion during flood stage.
(con['d)
~j TpTE ~F CO1.04+(J~ 91(nu4n '.~.~O~iM Qnvnm r.
DEPARTMENT OF NATURAL RESOURCES
H ar~is D Sherman.
