_ Mr, Wesley Potts • -4- • April 14, 1983 <br />2. A detailed revegetation plan should be given for all areas. A <br />committment to seeding brome grass is not sufficient. The Soil <br />Conservation Service can supply such a seeding mixture and <br />revegetation plan for all areas of the affected lands. This is <br />needed before the Board can approve this application. <br />3. Are any trees to be planted on the affected land? If so, what <br />species are to be planted, and where are they to be planted? <br />Exhibit G <br />1. The legal right-to-enter the property is not clear, expecially as <br />concerns the legal description of the lands to which it is to apply. <br />Furthermore, a legal right-to-enter must be provided for all of the <br />affected lands involved. This may include the haul road and the <br />mill area, as well. I suggest that you supply our Division with a <br />signed, notarized affidavit that states that Potco Mining and Milling <br />has the legal right-to-enter all of the areas of affected land, and <br />\ describe them on the affidavit to the nearest quarter quarter sections <br />involved. <br />Exhibit H <br />1. As I mentioned to you, our Division has a memorandum of understanding <br />with the U.S. Forest Service that mandates that the State of Colorado <br />will hold the reclamation bonds for mined lands on U.S. Forest Service <br />lands. At such time as you submit an appropriate bond to us, your bond <br />with the Forest Service should be released. <br />2. Reclamation costs for all necessary items in your reclamation plan <br />should be listed and a total reclamation cost should be calculated. <br />Costs for such matters as regrading, portal closure, revegetation, <br />topsoiling, etc. for all parts of the affected land should be considered. <br />The estimated reclamation costs will be used to get a reclamation bond <br />recommendation for our Board. <br />3. Our Division has financial warranty and performance warranty forms to <br />be used in bonding. A performance warranty (a written pledge to do the <br />reclamation) is provided by all operators. A financial warranty is <br />provided with this. It can be in any one of several forms that include <br />such items as a corporate surety, a bank letter of credit or a <br />certificate of deposit. As soon as the Board sets the amount of the <br />financial warranty (reclamation bond) and you deckle which type you <br />wish to use, I will send you the appropriate forms. Receipt and <br />approval of the warranties is the final step before permit issuance. <br />
