And that's why I <br />think that the question is relevant and the answer is relevant and I think <br />that more importantly, the issue is relevant as to how this thing is going to <br />be sequenced. It doesn't make sense to start a mine that you can't finish. <br />And that's exactly what, if you grant the permit, that's exactly the situation <br />that you put Battle Mountain and the people of San Luis in. And that's why <br />the sequencing in the rules is set up the way its set up. <br />MR. BARRY: That's your legal argument? That's -- I understand... <br />MR. N. COHEN: Well, it's -- it's my response to the objection as to <br />whether or not this is relevant. I clearly think it's relevant. I guess it's <br />your move now to rule on the relevancy. <br />MR. I'd like to know what -- how far they <br />are gonna take this thing, before they can get water rights. If they can't <br />get water rights for a year from now or for 6 months from now, which is <br />probably the minimum amount of time its gonna take 'em to get are augmentation <br />plan approved, I'd like to know where they're gonna be six months from now. <br />Because, if they don't get the plan approved, I think it's -- I think it's <br />certainly a relevant question for this hearing -- to know where they're gonna <br />be 6 months from now. Okdy. We don't have to do it day-by-day. <br />MR. N. COHEN: Neal, how do you tie in your water rights -- where -- <br />where -- you've got to do that, I think. <br />MR. N. COHEN: Well, let me ask you this, Mr. Dodson, if you don't have <br />water rights -- if you don't have water rights 6 months from now, how far into <br />• your mining program can you be? <br />
