Burden of Proof Reauitements [continued) <br />Should a precipitation event or anvmelt occ~a, the permittee shall submit adequate proof in order <br />for an exempticn to be claimed. Said proof shall be submitted as an attackment to the Discharge <br />Monitoring Report (IlMR) for the appropriate period. the Division shall determine the adequacy of <br />proof. As part of this determination, the Division shall evaluate whether the permittee could have <br />controlled the discharge in such a marcier that primary limitations could have been met. All aarnial <br />dewatering of the pocds shall meet 155 and total iron limitaticns. <br />3. Post-Minim Areas <br />Commencing at the time active mining has ceased asd surface areas have been returned to the required <br />contour and revegetation has begun, all applicable discharges may be eligible for limitations other <br />than those specified in Parts I.A.1. these post-mining, limitations shall remain in effect until <br />bard release. the permittee shall mtify the Division upon cessation of active m{nin~v so that <br />consideration of appropriate permit modifications can be made. <br />4. Best Manazement Practices - 001. 002. 005 <br />For the pH variance, as listed in Part I.A.1. to be in effect, the permittee must be taking all <br />reasonable +++~=~++-es to reduce the pH, including the vse of a 001 bubbler at the outfall(s). <br />Documentation of such shall be submitted with the applicable DhIIt acry time a pH level of war 9.0 <br />s.u. is reported. <br />1be permittee may develop other appropriate mP=~+res to control pH, such as the use of appropriate <br />algicides, aquatic life, etc. However, such man~~-es in addition to or instead of the ODZ bubbler <br />must be approved by the Division via a permit amenriment prior to their use. <br />B. Frequency and Sample Tyke <br />In order to obtain an indication of the probable cooplianra or noncompliance with the effluent <br />limitations specified in Part I.A.1, the permittee shall monitor all effluent parameters at the <br />following frequencies. Such monitoring will begin immediately and last for the life of the permit <br />unless otherwise mted.
