JACKSON, whose address for the purpose of this Agreement is in

81416, hereinafter referred to as Lessor, and CORN CONSTRUCTION
CO., a Colorado corporation, whose address for the purpose of
this Agreement is Box 1240, Grand Junction, Colorado 81501,
hereinafter referred to as Lessee;. WITNESSETH:
_ WHEREAS, Lessor is the owner of the following described
real property in the County of Delta, State of Colorado; to-wit:
PARCEL 1. Part of the Northeast Quarter of the
Southwest Quarter of Section 7, Township 15 South,
Range 95 West of the 6th Principal Meridian
described as follows: Beginning at the North-
east corner of the Northeast Quarter of the
Southwest Quarter of said Section 7, thence
West 32 and 32/34ths rods, thence South 16.rods
and 6 and 1/2 feet, thence West 24 rods, thence '
South 17 rods and 10 feet, thence West to the
Northeast corner of the Kepler Tract which is
a distance of 123.203 feet more or less, thence
South 46 rods.to the South line of the Northeast
Quarter of the Southwest Quarter of said Section
7, thence East.to the Southeast corner of the
said Northeast Quarter of the Southwest Quarter,
thence North to the point of beginning; AND
PARCEL 2. The Northwest Quarter of the Southeast
~', Quarter of Section 7, Township 15 South, Range
95 West of the 6th Principal Meridian; and
WHEREAS, the said property contains. sand and gravel, and
the parties desire to lease the premises so that Lessee may extract
such sand and. gravel therefrom;
NOW, THEREFORE, this Agreement witnesseth that:
1. Lessor hereby grants unto Lessee the exclusive right
to enter upon the real property above described and to extract,
process, stockpile and remove therefrom sand, gravel and topsoil.
2. Lessee agrees to proceed with due diligence and make
application to the Colorado Land Reclamation Board for the issuance
