The letter is enclosed for reference. Please aclrnowiedge the conditions for approval noted by the <br />OSE. Once the well permit is obtained a copy must be submitted to the Division. <br />34. Please explain how water from dewatering of the Gardels Pit will be managed to protect against <br />pollution of surface of groundwater both during and after the mining operation (Rule 6.4.7(2)(c)). <br />35. Please identify and name all ditches on and within 200 feet of the affected land. Please locate these <br />ditches on the appropriate maps and further explain the ownership of the ditches. If any ditches are to <br />cagy water as a result of the mining operation, please submit a written consent from the owner of the <br />ditch that will allow for the use of the ditch for conveying dewatering flows. <br />36. The Gardels Pit appears to be within the 100-year floodplain of the Big Thompson River. Please <br />provide the flood elevations(s) to be expected under a "worst case" flooding scenario and specific <br />mitigation measures that will be implemented to minimize the potential for any offsite impacts. <br />Legible copies of the Flood Insurance Rate Maps ("FIRM") through the mine reach would facilitate <br />the Division's review. <br />Rule 6.4.10 Exhibit J- Vegetation Information <br />37. The applicant states that in a letter dated June 4, 2002, that the US Fish and Wildlife Service <br />concurred with Weiland, Inc.'s findings that the proposed project would not adversely affect the <br />continued existence of the Ute-Ladies tressee orchid. Please provide the Division a copy of this <br />letter. <br />Rule 6.4.12 Exhibit L- Reclamation Costs <br />38. The Division will estimate a cost to reclaim the site based on the information submitted in the <br />application. <br />Rule 6.4.13 Exhibit M-Other Permits and Licenses <br />39. In Exhibit J under the heading Wetland Vegetation, the applicant states that a US Army Corps of <br />Engineers 404 Permit is currently in process. Please list the 404 permit in this exhibit and commit to <br />not disturbing the wetland areas until the permit is obtained. <br />Rule 6.4.16 Exhibit P-Municipalities Within Two Miles <br />40. Rule 6.4.16 requires the applicant to provide the address of the general office of each municipality. <br />Please provide the address for the City of Loveland. <br />Rule 6.4.19 Exhibit S- Permanent Man-Made Structures <br />41. Please be aware if the applicant encroaches into any easements as a result of the mining and operation <br />plan, then the applicant must obtain legal right of entry document from the easement holder. Please <br />state what easements will be included, and provide legal right of entry agreements. <br />42. The applicant states that Coulson Excavating is trying to reach agreements with owners of structures <br />within 200 feet of the affected land. Please be aware that the owners of the ditches, roads and wells <br />within 200 feet of the affected land will also need signed agreements. Please submit the agreements <br />from the City of Loveland, Western Area Power Administration & Platte River Power Authority and <br />other owners of structures within 200 feet of the affected land. <br />Under Rule 3.2(7) the Division is required to conduct an inspection prior to Board consideration. The <br />Division will schedule an inspection in July of 2005. Additional questions may arise as a result of the <br />
