Griffin, E.I. <br />7!23/2007 <br />Page 2 of 5 <br />event the operator walks away from the project and/or;allows the dewatering <br />operation to discontinue. <br />The proposed source of replacement for this pit is froi~n a lease of 7.21 <br />acre-feet of fully consumable efFluent, with the Consolidated Mutual Water <br />Company (Consolidated Water) and the water wi{{ be released from the Metro <br />Wastewater Treatment plant, which is located about 10 milers upstream of the <br />operation. A 0.5% per mile transit loss (5% overall loss) has~'been accounted for <br />in the replacement. The monthly depletions and replacemerrt requirements are <br />found on the attached annual accounting form. <br />Conditions of Approval <br />I hereby approve this substitute water supply plan, in accordance with Section <br />37-90-137(11), C.R.S., subject to the following conditions: <br />This SWSP acknowledges operation of the gravel pit between the <br />period of January 1, 2006 and December 31, 2007 (thE~,end of the <br />replacement water lease). <br />2. The total area of pond surface exposed after December, 31, 1980 for <br />the pit shall not exceed 2.41 acres. Should the total surface area <br />exposed exceed those amounts, an amendment will need to be filed <br />with this office. This approval acknowledges the mininit may have <br />been completed prior to the date of this letter and that the values of <br />water consumed in approval condition number 3 no longer apply <br />(except evaporation of exposed groundwater). However ~, the <br />applicant is still responsible for replacement of evaporative losses for <br />any exposed water surface (post December 31, 1980) %{ntil such time <br />an approved liner has been installed or an approved slurry trench has <br />been constructed around the pit area. <br />3. All pumping for dust control and dewatering discharges,to the South <br />Platte River shall be measured in a manner acceptable 4o the division <br />engineer. The losses associated with this mining operation must not <br />exceed a total of 6.86 acre-feet annually for 2006 and 3.84 acre-feet <br />for 2007 for the duration of this permit approval. These~losses include <br />4.14 acre-feet of evaporation from the proposed expos~lre of 2.41 <br />acres of groundwater, 6.08 acre-feet of water used for dust <br />suppression and 2.64 acre-feet of water lost in 90,000 gins of mined <br />aggregate for 2006 and 3.84 acre-feet of evaporative louses for 2007. <br />Should the annual losses at the site exceed 6.86 acre-feet prior to the <br />expiration date of this plan, an amendment will need to lie filed. <br />4.
