(Applicant) in accordance with
37-90-137(11) C.R.S. The required fee of $217 has been received (receipt no.
546445). Operations are reported to be reaching completion, however, until the
pit is lined, a substitute water supply plan is needed for evaporative losses.
The proposed plan describes the proposed uses for 2006 and 2007. The
proposed plan anticipates a maximum annual net depletion of 6.86 acre-feet (see
attached annual accounting form) for 2006 and a maximum annual net depletion
of 3.84 acre-feet for 2007. No groundwater was exposed within the permit
boundary prior to January 1, 1981.
The attached annual accounting form for 2006 shows a monthly
breakdown of the maximum annual depletions totaling 6.86 acre-feet which
includes 2.64 acre-feet loss for mined product, 0.08 acre-feet dust suppression
loss, and 4.14 acre-feet for net evaporative losses for a maximum of 2.41 acres
of exposed groundwater. No phreatophyte credit has been applied to this plan.
The attached annual accounting form for 2007 shows a 3.84 acre-feet figure for
net evaporative losses for a maximum of 1.41 acres of exposed groundwater.
This plan anticipates dry mining of the Speer Mining Resources Pit by
dewatering. The operator has obtained a bond in the amount of $678,169 to
cover the cost of remediation, including lining and/or backfilling the pit in the
