PART 785 Continued. <br />• <br />Section 785.19 Surface coal mining and reclamation operations on <br />areas including alluvial valley floors in the arid <br />or semi-arid areas west of the 100th meridian. <br />(a) Scope. This Section applies to each person who conducts or intends <br />to conduct surface coal mining and reclamation operations in, adjacent <br />to or under a valley holding a stream in the arid or semi-arid regions <br />of the United States west of the 100th meridian. <br />The mine plan area contains valleys holding perennial, intermittent <br />and ephemeral streams. The buffer zones described in Section <br />816.57 will be established to prevent disturbance directly in or <br />under the stream valleys shown on the Twentymile Park Hydrology <br />(Map 6). <br />• (b) No person shall engage in surface coal mining and reclamation <br />operations subject to this Section, except under a permit issued by the <br />regulatory authority in accordance with this Section. <br />Energy Fuels hereby applies for a permit to mine, in accordance <br />with and having shown compliance with 30 CFR 785.19. <br />(c) Alluvial valley floor determination. <br />(1) Before applying for a permit to conduct, or before conducting <br />surface coal mining and reclamation operations within a valley holding a <br />stream or in a location where the adjacent area includes any stream in <br />the arid or semi-arid regions of the United States, the applicant shall <br />either affirmatively demonstrate, based on available data, the presence <br />of an alluvial valley floor, or submit to the regulatory authority the <br />results of a field investigation of the proposed mine plan area and <br />adjacent area. The field investigations shall include sufficiently <br />• detailed geologic, hydrologic, land usP, soils and vegetation studies on <br />areas required to be investigated by the regulatory authority, after <br />785-6 <br />
