Section 785.18 (d) Continued. <br />• (9) The permit for the surface mining activities contains specific <br />conditions: <br />(i) Delineating the particular surface areas for which a variance is <br />authorized; <br />(ii) Identifying the particular requirements of 30 CFR 818 and the <br />regulatory prgram which are to be complied with, in lieu of the otherwise <br />applicable provisions of Section 515(b) of the Act, 30 CFR 816, and the <br />regulatory program; and <br />(iii) Providing a detailed schedule for compliance with the particular <br />requirements of Part 818 and the regulatory program identified under <br />paragraph (d)(9)(ii) of this Section. <br />(e) Review of permits containing variances. Variances granted under <br />• permits issued under this Section shall be reviewed by the regulatory <br />authority no later than 3 years from the dates of issuance of the permit <br />and any permit renewals. <br />Although no combined or concurrent surface and underground mining <br />activities are proposed within the mine plan area, a portion of the <br />final highwall in Energy Mine No. 1 will remain open for possible <br />use as an underground portal area. The decision to develop an <br />underground mine from this location will not be made until the <br />results of a feasibility study utilizing information developed from <br />the Ptiddle Creek pilot mine are available. Additional discussion <br />on this final highwall is set forth under Sections 780.18 (b)(3) <br />and 816.101. At such time as Energy Fuels concludes that an <br />underground mining operation is feasible within the mine plan area, <br />it will submit an amendment to this application seeking a variance <br />pursuant to this Section and setting forth a detailed plan for the <br />• conduct of underground mining as required by the applicable regulations. <br />785-5 <br />
