The Western Surface Agreement of 1992 between Peabody Coal Company and the International <br />• United Mine Workers of America provides for Health and Safety under Article III. Article III covers: <br />The Right to a Safe Working Place, Federal Mine Safety and Health Act of 1977, Mine Health and <br />Safety Committee, Access to the Mine, Reports, Safety Rules and Regulations, Cooperation in <br />Development of Mining Plans, Preservation of Individual Safety Rights, Physical Examination, <br />Workmen's Compensation and Occupational Disease, Safety Equipment and Protective Clothing <br />Allowance, Maintenance, Special Safety Problem Areas, and Settlement of Health or Safety Disputes. <br />Article XIV of the Contract pertains to training. This section includes: Orientation for New Employees, <br />General Retraining Programs, Safety Training for Specific Jobs, Maintenance Training and Rate of Pay, <br />and General Training Provisions. <br />Yoast Mine, Seneca Coal Company, and Peabody Coal Company are in continuing compliance with the <br />above Act and 30 CFR Parts 48, 40, 71 and 77, and the UMWA Contract Agreement of 1992. <br />Equal Employment <br />Seneca Coat Company and Peabody Coal Company have been, and will continue to be, an equal <br />opportunity employer and obligated to hire a full and effective utilization of qualified persons regardless <br />. of race, color, religion, sex, or national origin.
